Five courageous middle school students in West Virginia who took a stand against the unfair advantage of a transgender athlete in a track and field competition have been punished by the school board, igniting a legal battle that has now reached the doorstep of the US Supreme Court.

West Virginia Attorney General Patrick Morrisey didn’t hesitate to leap to their defense, filing a lawsuit against the Harrison County Board of Education after the students were sidelined from future meets following their principled protest during an April 18 shot put competition, as reported by West Virginia Watch.

The girls from Lincoln Middle School made a bold statement by refusing to participate in the event, which was ultimately won by Becky Pepper-Jackson, a 13-year-old who, despite being biologically male, is allowed to compete against girls due to taking puberty-blocking medication and estrogen hormone therapy.

Although West Virginia law explicitly prohibits transgender girls from competing on girls’ sports teams, a recent federal appeals court decision sided with Pepper-Jackson, stating that forcing her to choose between not participating in sports or competing on boys’ teams amounted to no real choice at all, according to Judge Toby Heytens.

Despite this setback, Morrisey remains undeterred, adamantly opposing both the court ruling and the treatment of the student-athletes who bravely spoke out against competing against Pepper-Jackson.

In an amicus brief filed on April 26, Morrisey, a Republican currently vying for the governorship, emphasized that the students’ actions were not disruptive or attention-seeking but rather a silent demonstration of their dissatisfaction with the repercussions of the appellate court’s decision.

Teaming up with one of Pepper-Jackson’s classmates, Morrisey announced his intention to petition the US Supreme Court to reconsider the case regarding the state’s regulations on transgender student-athletes, marking the second time the issue has been brought before the highest court in the land.

Riley Gaines, a former collegiate swimmer turned activist who has been vocal in her opposition to transgender athletes competing in girls’ sports, echoed support for the girls, condemning their coach’s decision to prevent them from competing as “insane” in a post on X.

Morrisey wasted no time in expressing gratitude for Gaines’ leadership on the matter, vowing to utilize all available resources to defend the rights of these courageous young girls.
